1. Acceptance of Terms

By accessing and using the services of Aulukya Construction ("Company," "we," "us," or "our"), you ("Client," "you," or "your") agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

3. Services Provided

Aulukya Constructions provides the following services:

  • Interior Designing - Turnkey interior design solutions
  • Project Execution - Complete project management & execution
  • Carpentry & POP Work - Expert carpentry and plaster services
  • Electrical & Flooring - Complete electrical and flooring solutions
  • Painting & Fabrication - Professional painting and fabrication work
  • Landscaping & Civil Work - Complete civil work and landscaping services
  • Project consultation and design services
  • Construction management and supervision

4. Project Agreements and Contracts

4.1 Contract Formation

All construction projects require a separate written contract that will include:

  • Detailed project specifications and scope of work
  • Timeline for completion with milestone dates
  • Total project cost and payment schedule
  • Quality standards and materials specifications
  • RERA compliance documentation where applicable
  • Warranty and defect liability terms

4.2 Payment Terms

  • Payment schedules will be linked to project milestones
  • Advance payments will not exceed 20% of total project value
  • All payments must be made through banking channels with proper documentation
  • GST will be charged as per applicable rates
  • Late payment charges may apply as per the contract terms

5. Client Obligations

  • Provide accurate project requirements and specifications
  • Obtain necessary approvals and clearances from local authorities
  • Ensure clear title and ownership of the construction site
  • Provide timely access to the construction site
  • Make payments according to the agreed schedule
  • Comply with all applicable building codes and regulations
  • Provide necessary utilities and infrastructure access

6. Quality Assurance and Warranties

6.1 Construction Standards

All construction work will be performed in accordance with Indian Standards (IS codes), National Building Code of India, and local building regulations. We maintain quality control through regular inspections and testing of materials.

6.2 Defect Liability

  • Structural defects: 10 years warranty
  • Non-structural defects: 2 years warranty
  • Electrical and plumbing: 1 year warranty
  • Finishing work: 6 months warranty

7. Regulatory Compliance

7.1 RERA Compliance

For projects requiring RERA registration, we ensure full compliance with the Real Estate (Regulation and Development) Act, 2016, including proper project registration, quarterly progress reports, and adherence to approved plans and specifications.

7.2 Environmental Compliance

We comply with all environmental regulations including Environmental Impact Assessment requirements, waste management protocols, and sustainable construction practices.

8. Safety and Insurance

  • We maintain comprehensive insurance coverage including contractors' all risk insurance
  • Worker safety is ensured through proper training and safety equipment
  • All safety protocols comply with the Building and Other Construction Workers Act
  • Third-party liability insurance coverage is maintained

9. Force Majeure

We shall not be liable for delays or failure to perform due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, labor strikes, material shortages, or other force majeure events.

10. Limitation of Liability

Our liability is limited to the contract value of the specific project. We shall not be liable for indirect, consequential, or punitive damages. This limitation does not apply to gross negligence or willful misconduct.

11. Intellectual Property

All architectural plans, designs, and technical specifications developed by us remain our intellectual property. Clients receive a license to use these materials for the specific project only.

12. Dispute Resolution

12.1 Mediation and Arbitration

Any disputes shall first be resolved through good faith negotiations. If unsuccessful, disputes will be resolved through arbitration under the Arbitration and Conciliation Act, 2015, with proceedings conducted in New Delhi.

12.2 Consumer Rights

Nothing in these terms shall prejudice the rights of consumers under the Consumer Protection Act, 2019, or other applicable consumer protection laws.

13. Termination

Either party may terminate a project contract for material breach after providing 30 days written notice and opportunity to cure. Termination procedures and payment obligations will be as specified in the individual project contract.

14. Governing Law

These terms shall be governed by and construed in accordance with the laws of India. The courts of New Delhi shall have exclusive jurisdiction for any legal proceedings.

15. Modifications

We reserve the right to modify these terms at any time. Changes will be effective upon posting on our website. Continued use of our services constitutes acceptance of modified terms.
